These Terms of Sale (“Terms of Sale”) govern all services and products (collectively, “Unanimous Service”) offered by Unanimous Media, LLC (“Unanimous,” “we,” “us,” or “our”) including through our websites currently located at https://www.unanimousmedia.com/ (this “Site”). In addition, the Unanimous Terms of Use and Privacy Policy are hereby incorporated and made a part of these Terms of Sale by this reference. PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING AN ORDER WITH UNANIMOUS.

Binding Effect

BY PLACING AN ORDER WITH UNANIMOUS, YOU AGREE, WITHOUT LIMITATION OR QUALIFICATION, TO BE BOUND BY THESE TERMS OF SALE, TO WHICH WE RESERVE THE RIGHT TO MAKE CHANGES FROM TIME TO TIME, CONSISTENT WITH APPLICABLE LAW. IF YOU DO NOT AGREE TO THESE TERMS OF SALE, DO NOT PLACE AN ORDER WITH UNANIMOUS.

General

Products offered through this Site are offered subject to availability. All products, services, prices, discounts, and promotions posted on this Site are subject to change without notice. You agree to be responsible for all orders placed using your account, username, password, or other security information. You shall not use the Unanimous Service to violate any applicable laws or to infringe upon any third party’s rights. All order delivery times are estimates, as it can vary based on the order. Unanimous will not be liable for any missed deadlines or delays, for any reason, and will not refund customers for this reason.

Age Requirements for Purchases

Unanimous sells products only to adults, not children, who can purchase with a credit card or other permitted payment method. You must be at least 18-years-old and fully able and competent to use the Unanimous Service and purchase services and/or products from us. Those under the age of 18-years-old may use the Unanimous Service only with the involvement of a parent or guardian. By placing an order with Unanimous or by clicking on “place order,” you hereby represent and warrant that you are at least 18-years-old and that you are legally able to enter into any and all purchase agreements with us and our partners, vendors, agents, and service providers.

Payment and Billing

By confirming your purchase at the end of the checkout process, you agree to accept and pay for the item or items ordered. By entering into any transaction on the Site, you represent, warrant and covenant that all information you provide is true, correct, and complete (including, without limitation, your credit card information and billing address); that any credit card transactions submitted by you are authorized; that charges incurred by you will be honored by your credit card company; that you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the Site at the time of your order; and that you are the legal holder of any credit card or payment account used to enter into any transaction on the Site.

You must provide truthful and accurate billing information. Providing any untruthful or inaccurate information may result in order cancellation. Before we accept and process an order, we may also request that you provide additional information. We reserve the right to refuse or cancel an order for any reason, including, without limitation, limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified through our efforts to avoid fraud and/or account abuse.

We reserve the right to limit the availability of, and/or to discontinue, any Unanimous Service, content or other feature described or available on our site to any person, entity, geographic area, or jurisdiction, at any time and in our sole discretion, and to limit the quantities and/or cancel orders of any content, product, service, or other feature that we provide.

If your order is cancelled after your credit card (or another payment account) has been charged, we will issue a credit to your credit card (or other applicable payment account) in the amount of the charge. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. We may request a pre-authorization for some orders placed online with a credit or debit card. This pre-authorization will not be billed to you; however, your card issuer may hold this amount for a short period. Your card issuer determines the length of time the pre-authorization is held. We do this to ensure that the card details are still valid and that you have sufficient funds to complete the transaction.

Important: Your order will not be processed until payment is received in full.

Sales Tax

You are responsible for paying all sales, use and other taxes, including any applicable duties, relating to any of your purchases of any Unanimous Service through the Site.

Promotional Codes

Promotional codes are limited in nature, void where prohibited and may expire or discontinue with or without notice. Promotional codes may not be copied, sold, or applied to prior or future purchases. They are not redeemable for cash and are subject to cancellation or change at any time for any reason. Any Unanimous Service eligible for promotional discounts may be limited to stock on hand, and rain checks may not be issued or honored.

Quantity Limits

In order to provide consumers with an enjoyable shopping experience on our site, or for any other reason, we reserve the right to limit quantities available for purchase. Quantity limits may be applied per order, per person or household, or to orders that use the same credit card, billing and/or shipping address, or share any other account or order attribute. We also reserve the right, at our sole discretion, to prohibit sales to dealers or resellers. For our purposes, “reselling” refers to purchasing or intending to purchase any product or products from us for the purpose of engaging in a commercial sale of the same with a third party.

Users who attempt to circumvent quantity limitations (e.g. by using multiple email addresses or accounts to order more than a stated limit or by placing multiple, excessive orders of the same product) may have orders denied and their accounts suspended from further activity. Any individual (based on credit card, email, billing address, or another attribute) who places more than 3 orders within 24 hours of an initial online product release may have those orders placed in our fraud queue for review. We will review orders in our fraud queue and may cancel multiple orders of the same item or items; your account may also be placed on suspension.

Returns and Refunds

If you are not satisfied with a product that you have purchased, you may return the item within fourteen (14) days of delivery for a full refund of the purchase price, excluding the shipping, handling, and other charges. The 3 product must be returned in good condition, in the original packaging (whenever possible), and with all paperwork, parts, and accessories to ensure credit. We do not take title to returned products until we receive them. Products designated as a final sale or non-returnable may not be returned. Please review the any and all information available on the Site and the relevant product page(s) regarding our specific return policies and product warranty information.

To start a return, or for shipping and return inquiries, you can contact us at shop@unanimousmedia.com with the subject line “RETURN REQUEST” or “EXCHANGE REQUEST” (as applicable) along with the Order Confirmation number. In the body of the email, please explain your request, and provide your full name, phone number, and address so we can prepare your return label and any further instructions with regard to return shipping. Once we provide a return label, please package the item (in the original packaging if possible), affix the return label and ship it out. Items sent back to us without first requesting a return will not be accepted

Order Shipping & Delivery

Unanimous will use commercially reasonable efforts to ensure that delivery schedules are met. Notwithstanding the foregoing, Unanimous is not liable for any delays in shipping. In no event shall Unanimous be liable for any direct, indirect, consequential or incidental damages resulting from any delay in shipment or delivery for any reason including, but not limited to, delays in shipments caused by weather conditions, shipping company delays, increase in volume during holiday season, information received on a holiday or a non-business day, international customs issues or any other circumstances beyond Unanimous’s direct control. Unanimous shipment and delivery dates are merely estimates calculated based upon estimates provided by our suppliers and cannot be guaranteed.

Unless otherwise explicitly stated, you are solely responsible for paying all shipping and processing charges relating to your purchases (including any product offered with a service) through the Site. Shipping promotions offered on the Site may not apply to all products and may be subject to other limitations.

Certain bulky or oversized products may include special shipping and handling charges in addition to shipping standard rates. Unless specifically stated on the Site, such special shipping and handling charges will be excluded from shipping promotions, and you will remain responsible for paying them.

All items purchased through the Site are made pursuant to a shipment contract with third-party carriers, which means that the risk of loss and title for such items pass to you upon our delivery to the carrier. Delivery for certain products may not be available to some addresses outside the U.S.

Customs, Duties, and Taxes for International Orders

Orders that are shipped to countries outside of the U.S. may be subject to certain customs duties, fees and taxes levied by the destination country (“Import Fees”). You may be subject to such Import Fees, which are levied once a shipment reaches your country. You are fully responsible for payment of all Import Fees and for payment of all additional charges for customs clearance. Customs policies vary widely from country-to-country. Unanimous does not have control over these fees, nor can we predict the exact cost of these fees. We are not responsible for informing you of the specific fees that will apply; it is your responsibility as the importer and the customer to check what your country’s requirements are for all customs fees before placing your order. You are responsible for contacting your local customs office for further information. Further, please note that additional charges may apply to high-quantity products depending on your access to a shipping dock and forklift, otherwise.
